> Terms and conditions of MVG Metallverkaufsgesellschaft mbH & Co. KG for consumers: contract formation, prices, made-to-measure goods without right of withdrawal, delivery, warranty and liability.

**Only the German version is legally binding.** This page is a translation of [Allgemeine Geschäftsbedingungen für Verbraucher](https://mvg-frankfurt.de/agb-verbraucher) for your convenience (German source version 93cca46cd629).

These terms apply to contracts concluded by MVG Metallverkaufsgesellschaft mbH & Co. KG, Hanauer Landstraße 421, 60314 Frankfurt am Main, with consumers (section 13 of the German Civil Code, Bürgerliches Gesetzbuch, BGB). Version: October 2026.

## Section 1 Scope

(1) These terms apply to all orders placed with us by consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession.

(2) Deviating terms of the customer do not apply unless we expressly agree to them. Individual agreements take precedence.

## Section 2 Conclusion of the contract

(1) The presentation of goods and configurators on our website does not constitute a binding offer, but an invitation to place an order.

(2) At checkout, the customer sees all items, prices and costs and can check their entries before submitting and correct them via “Zurück” (“Back”). By clicking “Zahlungspflichtig bestellen” (“Order with obligation to pay”), the customer submits a binding offer to conclude a contract of sale.

(3) The automatic acknowledgement of receipt and the confirmation of receipt of payment do not yet constitute acceptance. The contract is concluded when we accept the order by sending an order confirmation by email, or when we dispatch the goods or notify the customer that they are ready for collection. If we do not accept the order within five working days, the customer is no longer bound.

(4) In the case of payment in advance, a payment made before conclusion of the contract is an advance payment and does not constitute acceptance. If no contract is concluded, we will refund it without undue delay, at the latest within 14 days, via the payment method used for the order.

(5) Pricing errors: if a displayed price is based on an obvious technical error or input error, we may rescind our declaration without undue delay in accordance with the statutory provisions (sections 119 and 120 BGB). In that case, we will refund any payments already made without undue delay; on request, we will deliver at the correct price.

(6) We store the text of the contract and send it by email together with these terms and conditions and the cancellation policy. The language of the contract is German.

## Section 3 Prices and payment

(1) All prices are final prices in euros including statutory VAT. Shipping costs and selected additional services are shown separately before the order is placed.

(2) We deliver against payment in advance. The payment methods offered at checkout are available to choose from. We begin production after conclusion of the contract and receipt of payment.

(3) The customer may only set off claims that are undisputed or have been finally established by a court, or that arise from the same contractual relationship. The customer may only exercise a right of retention on the basis of claims arising from the same contractual relationship.

## Section 4 Made-to-measure goods

(1) All items that we cut or manufacture according to the customer’s specifications — cut-to-size parts, bent parts, laser parts, parts from uploaded files and semi-finished products sawn to length — are made to the customer’s dimensions. Full bars in mill length, full sheets in standard size and accessories without processing are standard goods.

(2) In the basket and at checkout, every made-to-measure item is marked “Anfertigung nach Ihren Maßen – kein Widerrufsrecht” (“Made to your dimensions – no right of withdrawal”). Before completing the order, the customer confirms that they have checked dimensions, quantities, material and drawings; we store this confirmation as evidence.

(3) The customer warrants that their drawings and data do not infringe the rights of third parties. We check the data only for technical manufacturability, not for suitability for the intended purpose.

## Section 5 Right of withdrawal

(1) For standard goods, consumers have a right of withdrawal in accordance with our [cancellation policy](https://mvg-frankfurt.de/en/cancellation-policy). The customer bears the direct cost of returning the goods and is liable for any diminished value resulting from handling that was not necessary to examine the goods.

(2) There is no right of withdrawal for made-to-measure goods under section 4 (section 312g(2) no. 1 BGB).

## Section 6 Delivery, collection and passing of risk

(1) We deliver within Germany or make the goods available for collection. We state the delivery time at checkout; it begins upon conclusion of the contract, but not before receipt of payment.

(2) In the case of shipment, the risk of accidental loss passes only upon handover of the goods to the customer.

(3) We ask that goods for collection be collected within ten working days of notification that they are ready for collection. After that, we may charge a storage fee of 0.5% of the price of the goods for each week or part thereof, up to a maximum of 5%; the customer remains entitled to prove that we have incurred no loss or a lower loss.

(4) Please report obvious transport damage to the delivery agent and to us immediately if possible. Failure to do so has no consequences for your statutory rights; however, it helps us to enforce claims against the carrier.

## Section 7 Retention of title

The goods remain our property until paid for in full.

## Section 8 Warranty

(1) The statutory rights in respect of defects apply. The limitation period is two years from delivery of the goods.

(2) We supply semi-finished products and manufactured parts in production quality, not in visible-surface quality. Light scratches and handling marks on the surface are customary. We agree on this deviation from the usual quality only if the customer specifically and expressly confirms it at checkout (section 476(1) sentence 2 BGB).

## Section 9 Liability

(1) We are liable without limitation in cases of intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz) and to the extent of any guarantee we have given.

(2) In the event of a slightly negligent breach of a material contractual obligation, the fulfilment of which is essential to the proper performance of the contract and on whose observance the customer may regularly rely, our liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.

(3) The statutory rights in respect of defects under section 8 remain unaffected.

## Section 10 Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (section 36 of the German Consumer Dispute Resolution Act, Verbraucherstreitbeilegungsgesetz, VSBG).

## Section 11 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This choice of law applies only insofar as it does not deprive the customer of the protection afforded by mandatory provisions of the law of the state in which the customer has their habitual residence.

(2) Should any provision be invalid, the remainder of the contract remains valid.
